Eroding Alaska town sues oil and power companies over global warming

ANCHORAGE, Alaska: A tiny Alaska village eroding into the Arctic Ocean sued two dozen oil, power and coal companies, claiming that the large amounts of greenhouse gases they emit contribute to global warming that threatens the community's existence. The city of Kivalina and a federally recognized tribe, the Alaska Native village of Kivalina, sued Exxon Mobil Corp. and BP PLC, seven other oil companies, 14 power companies and one coal company in a lawsuit filed Tuesday in federal court in San Francisco.

Kivalina is a traditional Inupiat Eskimo village of about 390 people about 625 miles (1,000 kilometers) northwest of Anchorage. It is built on an 8-mile (13-kilometer) barrier reef between the Chukchi Sea and Kivalina River. Sea ice traditionally protected the community, whose economy is based in part on salmon fishing plus subsistence hunting of whale, seal, walrus, and caribou. But sea ice that forms later and melts sooner because of higher temperatures has left the community unprotected from fall and winter storm waves and surges that lash coastal communities.

"We are seeing accelerated erosion because of the loss of sea ice," City Administrator Janet Mitchell said in a statement. "We normally have ice starting in October, but now we have open water even into December so our island is not protected from the storms." Relocation costs have been estimated at $400 million (€269 million) or more. A spokesman for Exxon Mobil, Gantt Walton, said the company was reviewing the lawsuit and had no immediate comment on it. Steve Rinehart, a spokesman for BP in Alaska, said he had not seen the lawsuit and had no comment.

The lawsuit was filed on behalf of Kivalina by two nonprofit legal organizations — The Center on Race, Poverty & the Environment and the Native American Rights Fund — plus six law firms. Reached by phone in Boston, attorney Matt Pawa said other lawsuits have been filed seeking damages from global warming, but this is the first one that has a "discretely identifiable victim." Damage to Kivalina from global warming has been documented in official government reports by the Army Corps of Engineers and the General Accounting Office, Pawa said.

The lawsuit invokes the federal common law of public nuisance, and every entity that contributes to the pollution problem harming Kivalina is liable, Pawa said. "You can sue them one at a time or some subset of them," he said. The lawsuit also accuses some of the defendants of a conspiracy to mislead the public regarding the causes and consequences of global warming. The suit was filed in California because that's where many of the defendants are located or do business, Pawa said.

Without commenting on the lawsuit, Exxon Mobil's Walton said the company takes the issue of climate change seriously. "Exxon Mobil is taking action by reducing greenhouse gas emissions in our operations, supporting research into technology breakthroughs and participating in constructive dialogues on policy options with NGOs, industry and policy makers," he said.

The other oil companies named were BP PLC, BP American Inc., BP Products North America Inc., Chevron Corp., Chevron USA Inc., ConocoPhillips, Royal Dutch Shell PLC and Shell Oil Co. Also named were Peabody Energy Corp., a major coal producer, and power companies AES Corp., American Electric Power Co., American Electric Power Services Corp., DTE Energy Co., Duke Energy Corp., Dynegy Holdings Inc., Edison International, MidAmerican Energy Holdings Co., Mirant Corp., NRG Energy Inc., Pinnacle West Capital Corp., Reliant Energy Inc., The Southern Co. and Xcel Energy Inc.

WASHINGTON: The Environmental Protection Agency says toxic chemical pollution from industry declined by about 2 percent in 2006 despite increases in releases by the mining and petroleum industries.

Companies reported that more than 4 billion pounds of toxic chemicals were released into the air, onto land, into waterways, injected deep into the ground or kept as onsite waste.

About one-third of the chemicals, or 1.4 billion pounds (640 million kilograms), were reported released into the air, a decline of 7 percent from 2005. The figures for 2006 are the latest available.

SYDNEY: As the first bush fires of the year rage through Australia's national forests, concern over climate change is intensifying among Australians.

A telephone survey of more than 1,000 people released Wednesday showed that 40 percent of Australians thought that global warming was a greater threat to security than Islamic fundamentalism. Only 20 percent thought it was less serious. The survey, by the U.S. Studies Center, based at the University of Sydney, came a day after the government's top scientific body said that rising temperatures and reduced rainfall were inevitable in Australia.

The report brought calls for more resources to be focused on mitigating the effects of future climate change rather than the current policy of trying to reduce greenhouse gas emissions. Extreme weather, including a drought that has persisted in some places for six years, has focused the Australian public on climate change, and it is shaping up as a major issue in general elections expected to be called in the next few weeks.

On Tuesday, Australia's most influential scientific research body, the government-funded Commonwealth Scientific and Industrial Research Organization, released a report that said an average temperature rise of 1 degree Celsius (1.8 Fahrenheit) was likely by 2030, along with many more days with temperatures of more than 35 degrees Celsius (95 Fahrenheit) and reduced rainfall over much of southern Australia, already the driest part of the driest inhabited continent on earth. "The message is that global warming is real, humans are very likely to be causing it and that it is very likely that there will be changes in the global climate system in the centuries to come larger than those seen in the recent past," the report said.

Recent events have made the subject even more urgent for many Australians. In the spring season, about 50 separate bush fires, fanned by unseasonably hot weather and strong winds, have already burned about 30,000 hectares, or 74,000 acres, of bush and national forest and destroyed a house. Large areas of the state of New South Wales, including Sydney, had a total fire ban in force Wednesday.

"It is very interesting to see how climate change has moved from the environmental field to the security sphere," said Alan Dupont, who heads the U.S. Studies Center, referring to the report released Wednesday. "Most of the government response has been about reducing greenhouse gas emissions rather than trying to manage the effects of the change."

The survey's results echo comments last week by the head of the Australian police, Commissioner Mick Keelty, that climate was a growing security concern. "We could see a catastrophic decline in the availability of fresh water," Keelty said. "Crops could fail, disease could be rampant and flooding might be so frequent that people, en masse, would be on the move. "Even if only some and not all of this occurs, climate change is going to be the security issue of the 21st century."

His comments provoked a sharp response from Prime Minister John Howard, who said terrorism was a more immediate threat to security than climate change. Howard was until recently a skeptic on climate change, and the opposition Labor Party has said that his recent attention on climate is driven more by polls than conviction. Australia has one of the world's highest per capita emissions of greenhouse gases. The government has refused to ratify the Kyoto Protocol, saying it is meaningless because it does not impose restrictions on the two greatest emerging emitters, India and China.

Environmentalists say that the time to tackle climate change is running out and that the major global economies need to commit themselves to radical cuts in greenhouse gas emissions. Both the United States and Australia have resisted efforts to set hard emissions targets and have encouraged the development of technologies like nuclear and "clean coal" in an effort to improve the efficiency of carbon-based fuel sources. The U.S. Studies Center survey relied on 1,213 phone interviews from July 13 to 29. It had a margin of error of plus or minus three percentage points.

The Nobel Peace Prize committee made a powerful statement Friday that the consequences of increasing carbon emissions are as dangerous as the ravages of war and - more directly - that "green" equals peace. The award to Al Gore and the United Nations Intergovernmental Panel on Climate Change reflects a growing conviction on the part of scientists, politicians and economists that such emissions will not only change climate patterns but also lead to economic mayhem, social upheaval and conflicts between nations or groups trying to survive in an increasingly disrupted natural environment. "This prize is an indication of the degree to which we've realized in the past few years that what happens in the environment is not just about natural resources but has so many different dimensions," said Achim Steiner, executive director of the UN Environment Program. "It recognizes that changes in the environment are likely to manifest themselves in tensions and conflicts."

The Bulletin of Atomic Scientists, which has for years maintained a "Doomsday Clock" to monitor the risk of global disaster from nuclear weapons, this year increased its warning level for the first time not because of weaponry but because of the threat posed by global warming. Many scholars believe that climate-related conflict is already upon us. "I believe there are many places that are in, or on the edge of, conflict because of climate change already, and this prize is a warning that on our current trajectory of climate change the risk will get a lot worse - these will be the conflicts of the 21st century," said Jeffrey Sachs, director of the Earth Institute at Columbia University in New York.

Sachs said that climate change had already helped ignite conflicts and wars in a swath of the world that extends from Sudan in Africa, through the Middle East and to Afghanistan. "All of these are in dry lands that have had significant environmental stress, which is probably related to climate change," he said. A recent UN report concluded that land degradation and desertification in the Darfur region of Sudan helped set the stage for the devastating tribal and ethnic conflicts of the past few years as poor people increasingly competed for depleted resources. "But for the environmental stress, I doubt this would have exploded," Sachs said. Large-scale migrations from Africa to Europe are already on the increase in part because climate change has made traditional livelihoods, from farming to fishing, less viable, experts say. If global warming continues on its current course, the Himalayan glaciers will melt, according to the most recent IPCC report, ultimately reducing the water supply of hundreds of millions of people, in India, Pakistan and Bangladesh.

"It does not take a lot of imagination to see that this will have drastic economic and social effects and lead to conflicts," Steiner said, as countries fight over who can take water from cross-border rivers. But the potential for conflict spawned by climate change is not limited to the poor countries of the world. Already, as the polar ice melts, countries are scrambling to claim previously covered resources. In his last days as president of France, Jacques Chirac suggested that his country might tax goods imported from countries which did not do their part to limit emissions. The UN panel and Gore have in their separate ways insisted that the world find a global strategy for limiting climate change and adapting to climate shifts that are already inevitable. But many others have joined forcefully in the mantra that peace and prosperity depend on the success in this quest - including former President Bill Clinton, Nicholas Stern, who was the chief economist of the World Bank, and business leaders like Richard Branson, the owner of Virgin Group.

In a report prepared for the British government and released last December, Stern suggested that projected climate change could shrink the global economy by 20 percent and plunge the world into recession. At a conference in New York earlier this month, Clinton noted that the world population was expected to rise from 6.5 billion to 9 billion in the next 43 years, a period in which further warming is projected, even if emissions were brought under control.

"Most of those people are going to be born in countries not able to support their current populations," Clinton said, "which gives a certain quaint air to the illegal immigration debate in Congress." Those conditions will make 2007 "look like a Sunday afternoon picnic," he added. "If China, India and the U.S. are going to have peaceful relations, they are going to have to negotiate a peaceful method for managing climate-related public goods - like natural resources, the atmosphere and biodiversity," Sachs said.
